OK, i'm building an Academy 1/32 Neuport and have added a scratchbuilt instrument panel as none was in kit and not on Instruction sheet. Panel is visible on boxart. Would this build be considered OOB contest legal?

I don't think so as scratch built parts are not out of the box, unless the instruction actually instruct you to scratch build the instrument panel.
